Early Contractor Involvement – NEC4 X22…

What Clients Get Wrong

This ECI clause allows clients to set a budget for the whole scheme and incentivise the contractor to deliver savings against it.

But many clients don’t use it to its full potential:

* Some rely solely on Option C or D gain/pain share, seeing that as enough incentive.
* Others seek savings, but only on what the contractor directly controls — faster build, cheaper procurement.
* Then there are clients who understand the real value: that experienced contractors can reduce overall scheme cost, not just construction cost.

Contractors bring insights from hundreds of projects — design tweaks, risk avoidance, logistics planning, utility interfaces, land strategy — all of which can drive significant savings across the entire programme.

Clients: don’t limit your thinking.

If you want real value, incentivise your contractors to help you deliver it. Clause X22 gives you the mechanism — so use it.
